1.Your Trip Contract

The person making the booking will be deemed to be the party leader. The party leader must be at least 18 years of age and guarantees they have the authority to accept and do accept on behalf of your party the terms of this agreement by all persons named on the booking. The party leader is responsible for making all payments due to us.

As soon as we receive all appropriate payments (see clause 3 below) we will confirm your trip by issuing a confirmation which shall be by email unless no email address has been provided, in which case it will be sent to you by first class mail, and a binding contract will come into existence between us. Please check your confirmation paperwork carefully as soon as you receive it. In particular, please check that all passenger names, titles and initials are correct and match the details in the corresponding passenger’s passport. Contact us immediately if any information on the confirmation or any other document appears to be incorrect or incomplete, as it may not be possible to make changes later. We regret we cannot accept any liability if we are not notified of any inaccuracy in any document within 7 days of receipt of your confirmation (5 days for tickets).

2.Agent for Travel Suppliers

When making your booking for your trip, our responsibility is to arrange for you to enter into a contract with the travel supplier such as airlines, cruise lines, and accommodation companies) named on your confirmation, for which we act as agent. As agent, we accept no responsibility for the acts or omissions of the suppliers or for the services provided by them. The suppliers’ Terms & Conditions will apply to your booking, and we advise you to read these carefully as they do contain important information about your booking.

3.Your Trip Price

Prior to confirming your booking, we reserve the right to increase or decrease the prices of unsold arrangements at any time according to market fluctuations. We also reserve the right to make changes to and correct errors in advertised prices at any time before your arrangements are confirmed. The price of your chosen arrangements will be confirmed at the time of booking.

Where you are paying a deposit only, you must pay a deposit of $200.00 per person for a land-based trip plus the cost of the flight in full where such payment in full is required by the airline. If you have booked a cruise, you must pay a minimum deposit of $500.00 per person which will be increased dependent upon the cruise line concerned to the full value of the deposit terms of the cruise line; plus, the cost of the flight in full where such payment in full is required by the airline. In addition, you must pay for any ancillary arrangements e.g. travel insurance, airport parking, etc., according to the booking terms of the relevant supplier.

You will be advised of all deposit details, holiday costs and costs of any additional services in addition to any third-party supplier costs which are either payable in full and/or non-refundable and non-changeable prior to booking. The balance of the price of your travel arrangements must be paid as cleared funds no later than the due date shown on your confirmation invoice. However, with any element of your booking, a supplier may ask for full balance payment at an earlier time than the Jetline balance due date (e.g. scheduled airline tickets) and, if this occurs, we will give you as much notice as possible and you will be advised of this possibility prior to booking. The additional amount paid will form part of your non- refundable deposit. If you would prefer, you can look at alternative arrangements rather than make an earlier payment (on the proviso that no cancellation charges would apply), but this could incur extra overall costs.

If any balance is not paid in full and on time, (including any surcharge where applicable), we shall cancel your travel arrangements and retain your deposit.

Once the price of your chosen arrangements has been confirmed at the time of booking, then, subject to the correction of errors, the price of your travel arrangements may change after you have booked, but we will only increase or decrease the price in the following circumstances:

If your trip includes air travel alone or in a package price, we will not increase the price after you have paid in full except to pass through increased taxes and other government charges. Otherwise, a surcharge or refund (as applicable) will be payable, subject to the conditions set out in this clause, if transportation costs or dues, taxes or fees payable for services such as landing taxes or embarkation or disembarkation fees at ports or airports increase or decrease or our costs increase or decrease as a result of any adverse or favorable changes in the exchange rates which have been used to calculate the cost of your arrangements. However, there will be no change within 20 days of your departure. Price increases or decreases after booking will be passed on by way of a surcharge or refund. We will absorb, and you will not be charged for any increase equivalent to 2% of the price of your travel arrangements, which excludes insurance premiums and any amendment charges. You will be charged for the amount over and above that. If this means that you have to pay an increase of more than 8% of the price of your travel arrangements, you will have the option of accepting a change to another trip if we are able to offer one (we will refund any price difference if the alternative is of a lower value) or cancelling and receiving a full refund of all monies paid, except for any amendment charges. If you choose to accept a refund, we will also charge an administration charge of $50 per person. Should you decide to cancel, you must do so within 14 days from the date on your final invoice.

4.Changes You Make Before Travel

If, after your booking has been confirmed, you wish to change your travel arrangements in any way, for example your chosen departure date or accommodation, we will endeavor to assist but it may not always be possible to make the changes. Any request for changes must be in writing from the person who made the booking. You will be asked to pay an administration charge of $50.00 per person per change, plus any further costs incurred we incur in making this alteration, together with all costs or charges imposed by any suppliers. You should be aware that these costs generally increase significantly the closer to the departure date that changes are made, and you should contact us as soon as possible. Please note that most airlines do not permit name changes for any reason after confirmation. If you wish to make a name change, this will be treated as a cancellation and re-booking. You will have to forfeit the amount you have already paid for your flight and pay the full, current cost of the flight again. Your ability to rebook will be subject to a seat being available for a new reservation.

Note: Certain travel arrangements (e.g. instant purchase tickets and scheduled airline tickets) may not be changeable or refundable in any circumstances after a reservation has been made (which will be notified to you prior to booking) and any alteration request could incur a cancellation charge of 100% of that part of the arrangements. You can transfer you booking to another person, who satisfies all the conditions that apply to this booking, by giving us notice in writing as soon as possible and no later than 7 days before departure. Both you and the new traveler are responsible for paying all costs we incur in making the transfer.

5.If You Cancel Your Trip

You, or any member of your party, may cancel your travel arrangements at any time. Written notification from the person who made the booking must be received at our offices. Notification sent to us by email will only be accepted if sent from the email address originally provided by the person who made the booking.

If your travel arrangements include (a) element/s that are non-refundable in the event of cancellation, e.g. flights from an airline that operates a no-refund policy or (b) have been purchased from a third-party voucher company for whom we act as a fulfilment agent, including (but not exclusively) Groupon, then the cancellation charge for (a) these element/s or (b) the voucher cost, will be 100%.

Apart from non-refundable elements, cancellation charges will be applied at the rates shown below, unless the suppliers’ cancellation terms are different, in which case the suppliers’ cancellation terms will apply.

Where the cancellation charge is shown as a percentage, this is calculated on the basis of the total price payable by the person(s) cancelling excluding insurance premiums and amendment charges. Insurance premiums and amendment charges are not refundable in the event of cancellation.

Period before departure that we receive written notification to cancel: Amount of cancellation charge:

  • More than 91 days Deposit only
  • 42-90 days 50% of trip price
  • 16-41 days 75% of trip price
  • 8-15 days 90% of trip price
  • 7 days or fewer 100% of trip price
To assure fairness to all, no exceptions can be made for any reason, including illness, inability to travel, State Department warnings, or fear of terrorism.

6.Insurance

We strongly advise you to purchase a travel protection plan to cover all non-refundable trip expenses. If you decline, you will personally assume full responsibility for any financial loss associated with your travel arrangements, and you could lose your travel investment and/or have to pay more money to correct the situation. For example, you will suffer a loss if: (i) your flight has been cancelled and your trip is nonrefundable; (ii) you need to cancel your trip due to illness; (iii) a hurricane, volcano or earthquake occurs while traveling and you are stranded; (iv) a terrorist incident occurs at the destination you planned on visiting; (v) your bags are lost and your medication is in them, and you need to have an emergency prescription filled; or (vi) your passport and wallet are stolen, and you need emergency cash and a replacement passport.

7.If we change or cancel your booking

While we always endeavor to avoid changes and cancellations, we must reserve the right to do so, in which case our liability will be limited to a full refund.

8.Airline Changes

Flight times given at the time of booking are for general guidance only and are subject to change. The latest flight times will be those shown when your check-in prior to departure. We advise you to check with the airline prior to departure in case there is a late flight change.

We are not liable if there is any change to a departure or arrival time previously given to you or shown on your ticket.

Please note that a flight described as “direct” will not necessarily be non-stop. In addition, if you do not use a segment of a flight itinerary without contacting the carrier directly, any remaining flight may be subject to cancellation without further notification. Where this situation arises, we are unable to accept responsibility for any costs incurred.

9.General Hazards of Travel

We have no special knowledge regarding unsafe conditions, terrorism, health hazards, or weather hazards. For a worldwide terrorism alert affecting U.S, citizens, go to: http://travel.state.gov/content/passports/en/alertswarnings/worldwide-caution.html.

For information about passports, visas, and possible dangers at your destinations, go to: https://travel.state.gov/content/travel.html, click on "Find International travel Information, then click on "Country Information", and fill in the name of the destination country. For medical information, we recommend contacting the Centers for Disease Control at (877) FYI-TRIP or go to http://www.cdc.gov/travel. You assume full and complete responsibility for checking and verifying any and all conditions regarding health, safety, security, political stability, and labor or civil unrest at your destination and connecting points.

10.Unavoidable and Extraordinary Circumstances

Except where otherwise expressly stated in these booking conditions, we regret we cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations or those of any supplier is prevented or affected by, or you otherwise suffer any damage or loss as a result of unavoidable and extraordinary circumstances or situations or events beyond our control.. Such events may include war or threat of war, riot, civil strife, actual or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire earthquake, volcanic eruption and all similar events outside our control.

11.Passports and Visas

International travel requires a passport valid 6 months beyond your intended return travel date. In many cases, you will also need to have multiple consecutive blank visa pages within your passport (the number varies depending on the destination(s)). Many destinations also require that visas be obtained prior to travel. You are solely responsible for complying with passport and visa requirements. Citizens of other countries must make their nationalities known to us and are responsible for obtaining proper documentation to enter the U.S. and any other countries where ports or options are involved.

12.Behavior

We can refuse to accept you as a customer or continue dealing with you if your behavior is disruptive and affects other trip participants, employees or third parties. If we do this, we will not be responsible for any additional costs that you have to pay. If you are prevented from traveling because in the opinion of any person in authority you appear to be disruptive, we will have no further liability to complete your holiday arrangements and will not be liable for any refund or compensation.

When you book with or through us, you accept responsibility for any damage or loss caused by you or any member of your party. Full payment for any such damage or loss must be paid direct at the time to the airline, accommodation owner or manager or other supplier in question. If you fail to do so, you will be responsible for meeting any claims subsequently made against us (together with our own and the other party’s full legal costs) as a result of your actions.

When speaking to any member of our staff we operate a zero tolerance to abusive language and behavior. Any telephone call where such behavior is experienced will be immediately terminated by the member of staff concerned. Any further communication will be required to be made in writing.

13.Your Email Address

For environmental reasons, airlines, tour operators, cruise lines, and other Suppliers no longer issue paper tickets by post. Also, some flight operators and cruise lines will require you to provide pre-departure information on-line. For this reason, you will be asked for an email address where your documentation can be sent as an attachment, and where you can print your e-tickets, accommodation vouchers, or other service vouchers as appropriate, and receive any important information from your supplier.

14.Special requests and medical problems

If you have any special request, you must advise us at the time of booking. Although we will endeavor to pass any reasonable requests on to the relevant supplier, we regret we cannot guarantee any request will be met. Failure to meet any special request will not be a breach of contract on our part.

We regret we cannot accept any conditional bookings, i.e. any booking which is specified to be conditional on the fulfilment of a particular request. All such bookings will be treated as “standard” bookings subject to the above provisions on special requests. If you or any member of your party has any medical problem or disability which may affect your arrangements, please tell us before you confirm your booking so that we can advise as to the suitability of the chosen arrangements. In any event, you must give us full details at the time of booking. If we or the supplier of the service in question reasonably feel unable to properly accommodate the particular needs of the person concerned, we must reserve the right to decline their reservation or, if full details are not given at the time of booking, cancel when we become aware of these details.

15.Accuracy of Prices and Other Published Details

Please note, where we publish information and prices, these may have changed by the time you come to book your arrangements. While every effort is made to ensure the accuracy of such information and prices at the time of printing, regrettably price amendments, especially flight price fluctuations, do occasionally occur. You must therefore ensure you check all details of your chosen arrangements (including the price) with us at the time of booking.

16.Resort Fees and Taxes

Resort fees are subject to change and variation over which we have no control. These cannot be pre-paid and must be paid locally and may be required as a cash payment. Resort fees are not included in your trip price.

17.Star Ratings

In all circumstances, star ratings for all accommodation featured, are determined by the tour operator or by the hotel, whichever is applicable. No ratings for properties are determined by Jetline Vacations.

18.Limitations and Waiver of Class Action

YOU AGREE TO PRESENT ANY CLAIMS AGAINST US WITHIN 30 DAYS AFTER THE TRIP ENDS AND TO FILE ANY LAWSUIT WITHIN ONE YEAR OF THE INCIDENT, AND YOU ACKNOWLEDGE THAT THIS EXPRESSLY LIMITS THE APPLICABLE STATUTE OF LIMITATIONS TO ONE YEAR. NEITHER PARTY MAY INITIATE OR BE PART OF A CLASS ACTION LAWSUIT OR LEGAL PROCEEDING AGAINST THE OTHER.

19.Applicable Law and Exclusive Jurisdiction

The Contract and these Terms are subject to the laws of England without regard to its conflicts of laws principles. YOU HEREBY CONSENT TO THE EXCLUSIVE JURISDICTION AND VENUE OF COURTS IN LONDON, UNITED KINGDOM, IN ALL DISPUTES ARISING OUT OF OR RELATING TO THIS AGREEMENT.

20.WARRANTY DISCLAIMER

THE WEBSITE AND ALL ELEMENTS THEREOF ARE PROVIDED ON AN "AS IS" BASIS WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE WEBSITE OR THE SERVER THAT IT MAKES AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. 21.Amendments

We reserve the right to update or alter these terms at any time, and we will post the amended terms on our website. Any amendment will take effect 10 days after being posted on our website at www.jetlineholidays.com/terms-conditions.aspx. An up to date copy of these terms, as amended, may be accessed at any time on our website and will be sent to you upon written request. You are deemed to have accepted any amendments to these terms on the date that is 10 days after their posting on our website. We recommend that you refer to the terms prior to travel to familiarize yourself with the most up-to-date version available.

22.Miscellaneous

These terms are personal to you, and you may not assign these terms or your rights or obligations hereunder to a third party without our prior express written consent. Our rights under these terms may be assigned, and its duties may be delegated. You agree to grant us (and third parties with whom we may engage in joint marketing) a worldwide, royalty-free, fully paid up license to use your photographic, video, or digital likeness solely for our promotional and/or commercial purposes. Facsimile transmission of any signed document shall be deemed delivery of an original. You consent to our recording of phone calls for quality control and fraud-prevention purposes. Any rights not expressly granted herein are reserved.
